Cigarette Bin Rental — Terms And Conditions

1. What you're renting
Filaret provides one branded cigarette butt collection bin (or as many as agreed via email) with a metal stand (the Bin) for your use. The Bin is provided free of charge for the agreed rental period.
2. Delivery and collection
We deliver, install, and collect the Bin at no extra cost. Delivery takes place by the date confirmed in your rental agreement.
3. Your responsibilities
During the rental period you agree to:
*Use the Bin only for collecting cigarette butts.
*Keep the Bin in reasonable condition.
*Make the Bin available for collection when the rental ends.
*Obtain any required persmissions if the Bin is placed on third-party property.
Normal wear is expected and is not your responsibility. If the Bin is lost, destroyed, or damaged through misuse, you will be charged its replacement value of €400 + VAT. Filaret determines whether damage qualifies as misuse.
4. Rental period
The rental starts when the Bin is delivered and ends at the date agreed via sign-up or further email exchange.
5. Ownership
The Bin remains the property of Filaret at all times, unless a separate purchase agreement is made.
6. Publicity
By renting a Bin, you agree that Filaret may publicly mention the rental arrangement — including your organisation's name, location, and the scope of the rental — for marketing, partnership, and investor communications. For any restriction, further details should be provided on sign-up or via e-mail.
7. Our liability
Filaret is liable only for direct loss caused by our own fault. We are not responsible for lost revenue, third-party claims, or any damage resulting from misuse of the Bin.
8. Force majeure
Neither party is liable for failing to meet obligations due to circumstances beyond their reasonable control. If such circumstances persist for more than 90 days, either party may terminate the rental.
9. Termination
Termination of the rental does not release either party from obligations that arose before or as a result of termination — including any outstanding damage liability.
10. Governing law and disputes
These terms are governed by Estonian law. Disputes are resolved first through negotiation; if unresolved, in Harju County Court.
11. Changes to these terms
Changes to individual rental agreements must be made in writing. If any provision of these terms is found invalid or unenforceable, the remaining provisions continue to apply.
